Citizen's Guide - Transparency in Public Administration

What is Transparency Law No. 52/2003? The Transparency Law ensures the openness of public administration activities to citizens through two important mechanisms: 1. Your participation in the process of developing normative regulations 2. Your participation in the decision-making process Who is this law addressed to? The Transparency Law involves collaboration between two partners: the public administration and the recipients of the regulations developed by it (citizens, non-governmental organizations, business associations). What does the law entail? We are obliged to make public draft normative regulations before they are adopted. After this moment, you, if you are interested, have the opportunity to formulate suggestions and recommendations regarding the regulations that were presented at the draft stage. What are the advantages of applying this law for you? - You are informed of the draft regulations of a normative nature proposed to be adopted - You are urged to express your views on these projects and thus get involved in solving the problems of the community What is the procedure? We publish an announcement in which we inform you that a certain draft decision of a public nature has been initiated and through which we ask you to express in writing your opinions, proposals, suggestions, the date by which you can submit them, as well as the place where the related materials can be studied. Legally established associations may request the organization of public debates on the draft decision, following which we will communicate the date, time and place where the debate will take place (within a maximum of 10 days of the request). The proposals and suggestions will be analyzed by the initiator and the local council, they have a recommendatory nature, and the decision to introduce them in the final decision will belong to the public authority.

Methods of Appeal

The methods of contesting the decision of the authority or public institution in the situation where the person considers himself/herself injured regarding the right of access to the requested information of public interest are provided for in art. 21 and 22 of Law no. 544/2001: 1. Administrative complaint – submitted to the head of the authority or public institution 2. Complaint to the administrative litigation section of the court in whose territorial jurisdiction he/she resides or in whose territorial jurisdiction the headquarters of the authority or public institution is located Note: The methods of contesting the decision of the authority in the situation where the person considers himself/herself injured by an administrative act are provided for in Law 554/2004 on administrative litigation.
